KyraLegal LLP Terms of Service
Introduction
Welcome to the terms of service ("Terms") for KyraLegal LLP ("KyraLegal LLP", "we", "us", or "our"). These Terms govern your access to and use of our website and the legal services we offer (collectively, "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to all of the Terms, you are not authorized to use the Services.
Client Engagement
Clients typically engage KyraLegal LLP's services through a Vakalatnama form, a standard document authorizing legal representation in India.
Billing and Payment
KyraLegal LLP does not use hourly billing for its core services and we do not provide a refund. We offer various engagement models depending on the specific needs of the client. These models may include fixed fees, retainers, or time-bound rates for specific services. However, there might be exceptional circumstances where time-based charges may apply, such as assisting the client with a call with the opposite party requiring an advocate's real-time assistance. These situations and associated fees will be clearly explained and outlined in a separate agreement.
Client Communications and Confidentiality
● Initial Contact: Your initial contact with KyraLegal LLP will typically be through a call, message, and emails in some cases. The paralegal will discuss your legal needs and help determine which advocate may be best suited for your case.
● Confidentiality: All client communications with KyraLegal LLP, including those via phone, message (e.g., WhatsApp), or email, will be considered confidential. This includes any sensitive information disclosed during these communications. KyraLegal LLP maintains strict confidentiality measures to protect your information.
Document Submission
KyraLegal LLP offers several secure methods for clients to submit documents:
● Email: This is a preferred method for most document submissions.
-
In-person drop-off (consultation fee may apply): This option allows for immediate document review, but a consultation fee might apply.
● Using External Courier Services: Clients can also choose to send documents via a trusted courier service of their choice. KyraLegal LLP does not offer its own courier service. If you require assistance with booking a courier service, a paralegal can assist you.
Clients may also choose to submit documents via WhatsApp at their own comfort level. KyraLegal LLP will accommodate these preferences while maintaining confidentiality.
Intellectual Property
The content displayed on or through the Services, including text, graphics, logos, images, and other materials (collectively, the "Content"), is the property of KyraLegal LLP or its licensors. You agree not to modify, reproduce, distribute, create derivative works of, or publicly display the Content without our express written permission.
Termination of Service
KyraLegal LLP is committed to providing exceptional client service and resolving any concerns you might have. However, termination of your access to KyraLegal LLP's legal services may be necessary in certain situations, such as:
● Client engaging in illegal activities.
-
Client behavior becoming disruptive or threatening to KyraLegal LLP and/or its staff.
-
Conflict of interest arising between the client and the existing client of KyraLegal LLP.
● Non-payment of fees after a reasonable grace period and attempts to collect payment.
KyraLegal LLP will prioritize clear communication and attempt to resolve any issues before resorting to termination. We also encourage exploring alternative dispute resolution (ADR) mechanisms to find mutually agreeable solutions.
The Client has the right to terminate this Agreement at any time upon written notice to KyraLegal LLP. However, the Client remains obligated to pay all fees earned by KyraLegal LLP up to the date of termination, in accordance with the agreed-upon fee structure.
Limitation of Liability
KyraLegal LLP is not responsible for any damages that may arise out of or in connection with your use of the Services. This includes, but is not limited to, direct, indirect, incidental, consequential, or punitive damages.
Dispute Resolution
KyraLegal LLP is committed to resolving disputes with clients amicably. In the event of a dispute, you agree to attempt to resolve it informally with KyraLegal LLP. If the dispute cannot be resolved informally, you agree to submit the dispute to binding arbitration in accordance with the Arbitration Rules of the Indian Arbitration Council. The arbitration shall be conducted in Bangalore, India.
Governing Law
These Terms and your use of the Services will be governed by and construed in accordance with the laws of India.
Entire Agreement
These Terms constitute the entire agreement between you and KyraLegal LLP regarding your use of the Services.
Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
